While MEA intended to have the new 10 year shelf life resolve past as well as future problems with funding and approvals delays MOE legal opinion determined that document language and consultation did not support that intention. They conclude that any project where the Notice of Completion was filed prior to the Sept 6th 2007 approval date for the new document was limited to the earlier 5 year shelf life from submission (not approval)
